Returns Policy & Jewellery Warranties

In the interests of health and safety and in accordance with victorian  state consumer law, we are unable to accept returns or exchanges on jewellery purchases. All sales are final at the time of purchase/ordering.

As body jewellery is worn in the skin, it is considered "contaminated" as soon as it is worn. It is unsafe (and unethical) to sell contaminated jewellery.

The only instances that we can accept returned jewellery is in the case of a repairs or warranty claim. 

PRE ORDERS / CUSTOM ORDERS
In accordance with Victorian state consumer law, Custom ordered jewellery cannot be cancelled or returned for change of mind, or incorrect jewellery being ordered.
As these pieces are made to ordered, specifically for the customer, Cherrycore will not accept financial liability for customer errors or change of mind.
When a customer places a custom order, they are agreeing to all terms in the custom order contract and thus are committing to the complete purchase of the items listed in there signed contract.


Lead times are subject to the individual manufacturers. This can be delayed beyond our general estimation, and this is beyond our control. We are unable to cancel or refund orders due to reasonable manufacturer delays. 


LOST JEWELLERY
It is the responsibility of the wearer to ensure that all components are kept securely fitted. Attachments can become loose with wear and tear; be sure to tighten threads and pins periodically.
Lost jewellery cannot be claimed under your Manufacturer's Warranty.

INSURANCE
While our jewellery has a manufacturer's warranty, wear and tear is not a manufacturing issue, nor is accidental damage, breaks or loss. If you would like insurance on your jewellery to cover you in those situations, please add your jewellery to your Home Contents Insurance Policy.

Cherrycore does not offer insurance cover on jewellery or cover repairs costs, including that of shipping for repairs.

WARRANTY STATEMENT
WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. 

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR, REPLACEMENT OR REFUND AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT. 

  1. WHO MAY USE THIS WARRANTY?
    Cherrycore, with a mailing address of 39 Main Street, Upwey, Victoria 3158, Australia (“Cherrycore”), extends this limited warranty only to the original consumer-purchaser of the Product (“you”). It does not extend to any subsequent owner or other transferee of the Product (as defined below).  
     
  2. WHAT DOES THIS WARRANTY COVER?
    This limited warranty covers defects in materials and workmanship of body jewellery purchased (the “Product”) for the Warranty Period (as defined below).
  3. WHAT DOES THIS WARRANTY NOT COVER?
    This limited warranty does not cover any damage due to:
    (a) transportation;
    (b) storage;
    (c) improper use;
    (d) exposure to solvents or chemicals;
    (e) failure to follow product instructions or to perform any preventive maintenance;
    (f) modifications;
    (g) unauthorised repair;
    (h) normal wear and tear; or
    (i) external causes such as accidents, abuse, or other actions or events beyond our reasonable control.  
  4.  WHAT IS THE PERIOD OF COVERAGE?
    This limited warranty starts on the date of your purchase and expires 3 month after said date. Cherrycore carries out quality control methods prior to install and shipping, as such it is reasonable that with wear, any undetectable defects during this process from manufacturing would be identifiable with in a 2 week period. This being the case our grace period for review is 3months. (the “Warranty Period”). The Warranty Period is extended if Cherrycore replaces the Product. Cherrycore may change the availability of this limited warranty at its discretion, but any changes will not be retroactive. This limited warranty is non-transferable, and any sale, transfer, or disposal of the Product by you will void this warranty; this limited warranty only extends to the original consumer-purchaser. For concern after 3months, Cherrycore can assist and see if the manufacturer can repair or provide cover on a case by case assessment. 
  5. HOW DO YOU OBTAIN WARRANTY SERVICE?
    To obtain warranty service, you must return the defective Product to Cherrycore during the Warranty Period and provide proof of purchase, including a copy of the original receipt.
  6. WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?
    If Cherrycore determines that a defective Product properly returned during the Warranty Period is covered under this limited warranty, Cherrycore will, in its sole discretion, replace the Product (or the defective part) free of charge by delivery of the replaced product (or part).
  7. LIMITATION OF LIABILITY
    THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND CHERRYCORE’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. CHERRYCORE’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL CHERRYCORE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
